Improper Appointment To The Ncab Again

I don't know....but I got six emails that appraisers said they had applied. I assure you I was not one of them. In my book if you take something that does not belong to you then you are a thief.

I have always said that someone of average intelligence can be taught to be an appraiser. As a USPAP instructor I often have students who are there due to NCAB disciplinary action. NOBODY can teach an adult with years of unethical behavior to become ethical after a 15 hour class.

This is not an important issue to many appraisers. Same old story, you don't care if someone is unethical as long as they are your friend, a member of your organization or able to help you out.


You hang in there USPAP. Your board is doing some good stuff and don't ever forget that they do have a boss and more than one. They are audited. If they aren't doing something right, just send a kind email. The ASC will likely see it or just cc the ASC on it when you send it to the board. You might want to "cc" other government agencies or officials as well depending on the issue.

Talk about someone getting their panties in a bunch over nothing...Since the law does not define the exact requirements that must be met in order to insure diversity, it is pretty doubtful that the governor's appointment is illegal just because there are now two board members from one city. When 9 spots on the board are represented by people from 8 different areas, that is a very geographically diverse group on the board. To accuse the guy who accepted the appointment of being unethical for doing so is quite a reach to say the least and is defamatory.

I agree and I don't know the man involved. The appointees have basically been "political" for years and that concerns me more than what has USPAP panties too tight. There are two good appraiser coalitions/groups in NC and some locals like to disparage both, but to each their own.

After reading comments from both sides, I think each side has present valid opinions.

If I interpret USPAP C's opening statement, his/her (sorry) concern is that the appointee should know the law and decline the appointment (especially since the appointee pointed out the law/ethics when it suited him).

If my interpretation is correct than I can understand USPAP C's concern and would have to agree with him that the appointee should have declined the appointment.

The only caveat would be if there aren't 9 distinct "geographically diverse areas of the State."

Anyone seeking a seat and filling out an application has to know what type of seat they are seeking and what the requirements are for the seat. State Appraisal law (93e) and NCAB "board rules" each have a link on the opening page of the NCAB website.

There is no desire for me to "hang in there". There is never a reward for blowing the whistle. For 15= years I have been exposing dishonesty and ethics issues with board members at the NCAB. Understand that the employees at the the NCAB are not board members nor are they "the board". I have never had an issue with any employee, investigator or staff person.

There have been so many "issues" over those 15 years that I can't even remember the
chronological order or time frame of the events. I won't list them all but some of the events that have been dishonest, unethical or even unlawful have included:

Two appraiser/legislators were given an exemption for taking ASC mandated continuing education. The board felt they were above the law. A complaint was filed with the ASC and the situation quickly resolved the violation.

A few years ago two appraisers were appointed by Gov. Perdue and within 10 days of the appointments they made significant "campaign contributions".

I called into question why board members were spending $80,000 per year on travel. After some inquires it was cut in half to $40,000.

Board members (some not all) were going to conferences and never attending a single session, event or seminar. Safeguards were put into place to stop this. There was also some improper "expenses" and payments taking place and that was stopped. Legal counsel at the NCAB has no problem stopping improper conduct.

Board members were all staying in the same hotel the night before and during 2 day board meetings. They were sitting in the bar discussing and deciding cases.......outside the board room. This was stopped.

There are at least 10 more incidences of questionable conduct that I am aware of.


Conduct such as this is acceptable to many people , many appraisers. None of this behavior is acceptable to an honest, ethical appraiser.

Wow. So the ASC has stood up to the challenge from what you are saying I think. If not, then the CFPB might be the next best source of justice or maybe the Federal Trade Commission. I guarantee you the buck stops with the FTC. They will say the buck stops here. They are kind of like the end of the line outside of court.

Neither the FTC nor the CFPB have any authority over a state appraisal board.
