In a small claims lawsuit, it will be decided in a local court in TN. You sue for $600., The defendent has to appear or have an attorney appear. If you get judgement, you win case and court costs.

You can put lien on subject at that point. That will be your choice.

The lender will pay you long before you file lawsuit.

VA can help you on getting paid. FHA can also. Don't let people not pay you.
 
The VA was of NO help collecting in the Phoenix Region. Despite requests for their assistance, I was never ccd on any emails from them. I think part of it was they were too busy.

Small Claims Court? If you have time for that - good for you. I don't. Especially not when the property and appraisal were in a different state. We'll just keep hounding them and whittle it down to a manageable number that we can live with not collecting. :cautious:
I took four lenders to small claims court over the years. All four times, they were a no show and I won. How much did I collect? $0. There is nothing to force them to pay. They can file bankruptcy, they can shut down and open up under a new name. Is it worth it? Nope.
 
Did you know that 40% of all Dollars in existence were printed in the last year? A larger money supply means that each individual dollar buys less than what it did before the pandemic money printing. We see this every time we go to the store. Based on the number of new dollars alone a cart of groceries that cost $100 before the pandemic now costs $166.67. Add in the shortages due to supply chain problems and the total price you pay has been bid up to even more. Following the money supply formula, a 1004 appraisal report that cost $725 before the pandemic should now costs $1208. Add in the appraiser shortage and scheduled vacations over Christmas and you should expect to pay up to double that to get a report back before the New Years.

Idk how Texas rolls. We don't roll that way in Tennessee. Some people may. I don't. I get my money the easy way or the hard way.

Many would say it is not worth your trouble and expense. It is ethics to me. You owe me, you pay me.

I have seen the mortgage fraud that occurred. I don't play.

Take no prisoners. You are judge and jury. They owe you, they pay you.

If you do charity, that is all in your hands. That is fine.

So, you will place a lien on the property and punish the borrower, not the lender. Then, you cannot collect until they sell. So, it could be years.

I can collect on a bad check in some counties easier than I can collect on a judgement against a mortgage company.
